Is an AI EHR HIPAA compliant?

An AI EHR can be HIPAA compliant, but “HIPAA-compliant” alone is no longer sufficient in 2026. Because ambient AI captures PHI to cloud servers, a trustworthy vendor must sign a Business Associate Agreement (BAA), bind its subprocessors, offer model-training opt-outs, encrypt data, and provide auditable access controls.

What should practices verify before adopting an AI EHR?

Five things, in writing: a signed BAA before any PHI is touched; contractual limits on whether patient data can train AI models; audio and data retention timelines; subprocessor commitments (who else touches the data); and audit logging that satisfies HIPAA’s access-tracking requirements.

Marketing claims are not compliance. Ask for the BAA and the security documentation — a serious vendor produces both without hesitation.
